These terms cover using this website and working with us. Before any work starts, we'll also send you a written quote that sets out exactly what you're getting and what it costs. If the quote and these terms disagree, the quote wins.

Using this website

The information on this website is general. We try to keep it accurate and up to date, but prices and services can change. The written quote we send you is what counts.

The design, words and images on this website belong to Darbry Web Works. Please don't copy them without asking.

Quotes and prices

• All prices are in Australian dollars. We are registered for GST, and all our prices include GST.
• A quote is valid for 30 days.
• The founding price is for our first three website clients only. Once those spots are taken, the standard price applies.

Website builds

• Payment: a 50% deposit before work starts, and the remaining 50% when the website is finished, before it goes live.
• We show you the design before it goes live, and make reasonable changes until you're happy with it. Changes that add new pages or features beyond the quote may cost extra, and we'll tell you before doing them.
• You give us your logo, photos and business details, and confirm you have the right to use them.
• Once you've paid in full, the website's content and design are yours to use.
• Your domain name (your web address) is registered in your name and stays yours. If you move away from us, we'll help you take your website with you.

Cancelling a website build

• You can cancel a website build at any time by telling us in writing.
• Before we start work: we refund your deposit in full.
• After we start, before you approve the design: we keep the 50% deposit to cover the design and setup work already done. You owe nothing more.
• After you approve the design: you pay 75% of the total price (the deposit plus a further 25%) to cover the build work done after your approval.
• If we don't hear from you: if we're waiting on your content, photos or feedback and haven't heard from you for 60 days, we'll contact you twice. If you still don't reply within 14 days, we'll close the job. Payments already made cover the work done, and we can restart later under a new quote.
• If we cancel: if we can't finish your website for any reason of our own, we'll refund any money you've paid for work we haven't done.

Hosting & Care

• Hosting & Care comes with every website build at $49 a month, unless you opt out when you accept your quote.
• It covers hosting your website, keeping backups, checking your quote form each month, and up to 2 small changes a month, such as a new phone number, price, photo or opening hours. Unused changes don't carry over to the next month.
• New pages or new features aren't included. We'll quote them before doing any work.
• It's paid in advance each month. There's no lock-in contract. You can cancel by giving us 30 days' notice in writing, and we'll help you move your website.
• If you opt out, you arrange your own hosting, and any changes are quoted as one-off jobs.

Monthly services

This covers follow-up emails, review requests and social media posting.

• There's no lock-in contract. You can cancel by giving us 30 days' notice in writing.
• You are responsible for having your customers' permission before we email or message them for you. Every email we send includes an unsubscribe link.
• We'll show you the wording of emails and review requests before they start, and you can change them at any time.

What we can and can't promise

We build websites and run marketing to help you win more work, but we can't promise a set number of calls, jobs, reviews or a particular position on Google. Search engines and social media platforms set their own rules and change them often.

Your rights under Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms takes away those rights. If something we've done isn't right, tell us and we'll fix it.

Liability

As far as the law allows, we aren't responsible for indirect losses such as lost profits, or for problems caused by services we don't control, such as your hosting account, email provider, Google or social media platforms.

Privacy

How we handle personal information is explained in our privacy policy.

Governing law

These terms are governed by the laws of Western Australia.
